CONSENT TO ELECTRONIC RECORDS AND COMMUNICATIONS
E-SIGN DISCLOSURE

Please read this document carefully and retain a copy for your future reference.

As part of your relationship with us, you have the right to receive certain information "in writing" – which means you are entitled to receive such information on paper. The federal ESIGN Act and certain state laws allow us to provide this information to you electronically, instead, with your prior consent. Your Consent to use Electronic Records (defined below) during our relationship allows us to serve you more effectively. This document informs you of your rights when receiving Electronic Records from us in connection with your ("Account").

Definitions used in this consent:

  • "You" and "your" means the person giving this Consent and also each additional applicant, accountholder, authorized user, and account contact.
  • "We", "us" and "our" refer to the retail sellers participating in the UGA Finance Program administered by Universal Account Servicing, LLC, and their current and future affiliates, agents, and assigns and any other individual or entity that provides services related to your Account.
  • "Electronic Records" are any legally-required disclosures, agreements, Account information, notices, statements, and other information to you electronically. Electronic Records may include, but are not limited to, applicable disclosures pursuant to the Equal Credit Opportunity Act; ESIGN Act Disclosure and Consent; the Truth in Lending Act; the Gramm-Leach-Bliley Act; and any other federal, state or local law, or regulation applicable to your application or Account.

Your Consent to Use Electronic Records and Signatures. By agreeing to this Consent to Electronic Records and Communications, you acknowledge receipt of this document, consent to the use of Electronic Records and electronic signatures in connection with your Account (collectively, "Your Consent"). Your Consent is effective until you withdraw Your Consent. We may always, in our sole discretion, provide you with a document in writing, even when you have chosen to receive it electronically.

These electronic communications may include your name and some information about your Account, including your balance or the due date; however, we will not include your full social security number. Electronic communications may be reviewed by any party with access to your Account, the e-mail account you have provided to us for delivering these electronic communications, or the hardware or software you use to view your Account information or your e-mail account.

How to Update Your Records. You agree to promptly update your e-mail address if a change occurs by updating your information through uPortal360 (https://www.uPortal360.com) or the website listed on your billing statement or by calling customer service at 1-888-233-2302

Method of Providing Communications to You in Electronic Form. All communications that we provide to you in electronic form will be provided either (1) via e-mail, (2) by access to a web site that we will designate in an e-mail notice we send to you at the time the information is available, or (3) to the extent permissible by law, by access to a web site that we will generally designate in advance for such purpose.

Hardware and Software Requirements. To access and retain Electronic Records electronically, you will need to use the computer software and hardware identified below. "Current Version" means a version of the software or hardware that is currently being supported by its publisher. You will need the following:

  • Internet Access,
  • Current Version of an Internet Browser,
  • Adobe Acrobat Reader or other software capable of viewing PDF (portable document format) formatted files,
  • Sufficient electronic storage capacity on your hard drive or other data storage facility, or a means to print or store notices and information through your browser software,
  • A valid email address, and
  • A personal computer, mobile device, or other device capable of supporting the requirements listed above.

Paper Copies of Communications. Upon your request we will provide you with a paper copy of any communication that we have provided to you electronically. If you would like a paper copy of any communications, please write our third-party billing service provider: UNIVERSAL ACCOUNT SERVICING, LLC ATTN: Account Services, Universal Account Servicing, LLC, P.O. Box 12027, Parkville, MO 64152 or call us at the phone number listed on your billing statement. There will be no charge for a paper copy of any communication we have sent you electronically.

Communications in Writing. All communications in either electronic or paper format from us to you will be considered "in writing." You should print or download a copy of this Consent and any electronic communication that is important to you for your records.

Federal Law. You acknowledge and agree that Your Consent is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business and communicate with you by electronic means.

How to withdraw consent.  You may withdraw Your Consent to receive communications in electronic form by writing our third-party billing service provider: UNIVERSAL ACCOUNT SERVICING, LLC ATTN: Account Services, Universal Account Servicing, LLC, P.O. Box 12027, Parkville, MO 64152 or by accessing your account online (https://www.uPortal360.com).  Any withdrawal of Your Consent to receive electronic communications will be effective only after we have a reasonable period of time to process the withdrawal.

IMPORTANT TERMS FOR ELECTRONIC STATEMENTS

In addition to the above, if you have elected to receive electronic statements, the following information applies:

1. Statement Inserts. Any inserts that would be included with a statement sent by U.S. mail may also be sent to you electronically. If an insert contains legally required material, to ensure that you receive the necessary material, we may send you a paper copy of your statement in addition to making the statement available to you electronically. Any legally required insert that would not be available electronically will be sent to you by U.S. mail.

2. Payment Information. When you elect to stop paper statements, you must still make payments in accordance with your Agreement. You can do this through an electronic bill pay service (whether through our website or using a third party servicer or bank) or by mailing your payment to us at the address shown on the electronic statement.

3. Returned E-mails. If e-mails advising you of the availability of statements are returned to us, we may cancel your enrollment for electronic statements and resume sending you paper statements in the mail. If this happens, you will need to re-enroll to receive electronic statements with updated information.

4. SPAM Filters. We will make every effort to ensure our e-mail notifications are properly listed with all SPAM filter agencies. However, you are responsible for ensuring that any SPAM filters recognize e-mail originating from us. If you fail to receive e-mail notifications from us after enrolling for electronic statements, please check with the provider of your e-mail account and/or the SPAM filter associated with your e-mail account.

5. Account Delinquency. We reserve the right, at any time and without notice, to stop providing you with electronic statements and provide you with paper statements, if your Account is not maintained in good standing.

6. Cancellation. We reserve the right, at any time, to stop providing you electronic statements and provide you with paper statements. If we do so, we will provide you with prior notice, except in the case of account delinquency. Reasons for cancellation include, but are not limited to, not viewing your last three electronic statements.

YOUR CONSENT TO ELECTRONIC COMMUNICATIONS ("COMMUNICATIONS") You provide Your Consent and agree that we may contact you for any lawful reason, including, but not limited to, in connection with your application and Account, including for the collection of amounts owed to us under any contract granted. We may contact you at such addresses or numbers (including wireless cellular telephone numbers and ported landline numbers) as you may provide to us from time to time. We may use any means of communication, including, but not limited to, postal mail, telephone, electronic mail, text messaging, voice messages, or other technology, to reach you. You agree that we may use automated dialing and announcing devices which may play recorded messages. We may also send text messages to your telephone. You are not required to provide your mobile telephone number as a condition of receiving credit, and you may withdraw Your Consent for us to use automated dialing systems and pre-recorded messages in connection with your mobile telephone number at any time by by writing our third-party billing service provider: UNIVERSAL ACCOUNT SERVICING, LLC ATTN: Account Services, Universal Account Servicing, LLC, P.O. Box 12027, Parkville, MO 64152 or calling 1-888-233-2302.

By providing Your Consent, you 1. Acknowledge that you have at least the minimum hardware and software requirements listed above to access and retain Electronic Records in the designated formats described above; 2. Acknowledge that you have read this information about Electronic Records and Communications; 3. Consent to having legally-required disclosures, agreements, Account information, notices, statements, and other information provided or made available to you in electronic form and doing business with us electronically; 4. Acknowledge that you may request a paper copy of an Electronic Record at no charge to you; and 5. Indicate your intent to utilize electronic signatures to apply for credit and process transactions on your Account.

Electronic Consent. You acknowledge that by clicking on the "Submit", "I Agree", or similar button, you are indicating Your Consent to sign up for electronic communications and that this shall constitute your signature, Your Consent, and your acceptance.
